Cruz invites you to live the GT3 in the Circuit of Barcelona

Cruz launches the "Vive la GT3" promotion, which draws a weekend for two people to enjoy from the inside the final race of the season of the Blancpain Endurance Series GT3. It will take place on September 28 and 29 at the Circuit of Barcelona - Catalonia, with the collaboration of the Black Falcon competition team.

In order to participate in the Free Draw and obtain the Prize indicated in the PRIZE stipulation, it is necessary that:

1. The Participants have purchased a Cruz product at some point and have registered it correctly in the Product Registration section of the website cruzber.com
2. The Participants have filled in and sent the form that is required in the page vivelagt3.cruzber.com. The resolution of the draw will take place on September 4, 2019, the winner will be made public on September 5, 2019 through the website of the Promotion vivelagt3.cruzber.com, the corporate website of Cruz, Cruz social networks and the Winner will be contacted by any of the channels provided by him privately. If one (1) day has passed since the Winner’s name is made public and it is not possible to contact him by any of the channels provided, he will lose the right to obtain the Prize and it will be awarded to the Alternate winner.

1. SUBJECT

With the object of promoting its Cruz Brand sales and rewarding users of their Brand, the Company CRUZBER SA (hereinafter referred to as “CRUZBER”), with Spanish VAT Nº A-14018311, with corporate address at Pol. Ind. Las Salinas II parcela 12, C.P. 14960 Rute (Córdoba) and general email address info@cruzber.com, promotes (the “Promotion”) a free Draw called “Promotion Cruz – Vive la GT3” (the “Draw”). This Promotion will be run in accordance with the following legal terms and conditions (the “Legal Terms and Conditions”):

2. PROMOTION PERIOD

The Promotion will run from the 8th July 2019 at 00:00 (CEST) to the 31st August 2019 at 23:59 (CEST).

3. TERRITORIAL SCOPE

This Promotion is valid all across Europe.

4. HOW TO PARTICIPATE

Participants must be natural persons over the age of 18 having legal residence in Europe. Those who are under 18 years old cannot participate in the draw. CRUZBER’s staff members are excluded from this Promotion.

5. PRIZE

There will be just one prize for the winner and it consists of:

Travel expenses from the country of origin to Barcelona, the trips from the hotel to the circuit, as well as any other expenses in which the winner may incur during their stay are not included. The winner will be responsible for paying any expenses not included in the above mentioned points. The Prize may not be object to change, alteration or compensation at the request of the winner. The Winner may refuse the Prize obtained, but in no case shall an alternative prize be offered, nor shall such waiver give right to compensation.

6. HOW THE PROMOTION WORKS

In order to participate in the Free Draw and obtain the Prize indicated in the PRIZE stipulation, it is necessary that:

1. The Participants have purchased a Cruz product at some point and have registered it correctly in the Product Registration de section of the website cruzber.com

2. The Participants have filled in and sent the form that is required in the page vivelagt3.cruzber.com. During the registration process, each Participant will be assigned a code automatically and randomly. The Draw will be made through this code, obtaining a Winner and an Alternate.

The resolution of the draw will take place on September 4, 2019, the winner will be made public on September 5, 2019 through the website of the Promotion vivelagt3.cruzber.com, the corporate website of Cruz, Cruz social networks and the Winner will be contacted by any of the channels provided by him privately. If one (1) day has passed since the Winner’s name is made public and it is not possible to contact him by any of the channels provided, he will lose the right to obtain the Prize and it will be awarded to the Alternate winner.

7. TAX REPORTING

CRUZBER informs the Winner that, in accordance with the current law in force, the Prizes will be considered as capital gains not derived from transfers of capital assets, which are subject to direct taxation in the Personal Income Tax (IRPF for its Spanish acronym). The Winner is responsible for tax compliance.

Only if required by law, CRUZBER will account for tax withholding on the Personal Income Tax -IRPF-. Likewise, CRUZBER will issue the corresponding certification with the object of allowing the Winners to comply with their tax obligations. Under no circumstances shall CRUZBER be held liable for any incorrect tax declaration that the Winners of the Prize could make.

8. PERSONAL DATA PROCESSING

CRUZBER SA is responsible for the treatment of personal data collected by this promotion in compliance with the Regulation (EU) 2016/679 of April 27, 2016 (GDPR) and the 3/2018 Organic Law of December (LOPDGDD), regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data. The processing of the data will be carried out with the aim of managing the participation process in the current Promotion (contacting contestants, winners and carrying out the awards-giving process), send commercial communications related to our products and services, conduct statistical studies and process orders or any type of request made by contestants. The data will be kept as long as there is a mutual interest to maintain the purpose of the treatment and, when it is no longer necessary for this purpose, it will be suppressed with adequate security measures to guarantee the pseudonymization of the data or the total destruction of the data. The data will not be communicated to third parties, except legal obligation. 9. CONSENT FOR USE OF NAME AND ASSIGNMENT OF PUBLICITY RIGHTS

CRUZBER reserves the right to use the name and the image of the Winners in all aspects related to the development of the Promotion. Thus, the Participant agree to the use, publication and reproduction, all over the world and without limitations, by CRUZBER, of their Image and their name in any type of publicity, promotion and/or publication (Internet included), or any other means, with promotional or informative purposes only and when these are related to the current Promotion. There will not be any financial reward of any type for the Participants. This agreement may be revoked at any time by the Winners, entitling CRUZBER to compensations for the damages and losses that may result.

10. MODIFICATIONS

In the event of unforeseen circumstances, CRUZBER reserves the right to make changes, cancel, shorten or extend this Promotion. CRUZBER commits to give those modifications the same level of publicity as to these Legal Terms and Conditions.

11. ACCEPTING THE TERMS AND CONDITIONS

The participation in this Promotion implies the acceptance of all the clauses in these Terms and Conditions as well as the acceptance of the criteria of CRUZBER SA in the interpretation of these criteria.

12. APPLICABLE LAW AND JURISDICTION

This Promotion is governed by the Spanish law. For any controversy which could result from the interpretation of this document, the parties submit to the jurisdiction of the Courts in Lucena, with express waiver to any other jurisdiction to which they might have recourse.
